Snapmad

We (Snapmad) provide a service that allows users (you) to upload and store digital photographic images and access them through our site and/or the user’s account – so you can order canvas photo prints, photo prints, mugs, personalised products or other non-personalised products.

Image storage

As part of the process to create your order, you upload image/images to our site. We don’t charge for image storage, but as a general rule only keep confirmed order images for a maximum of 30 days – although this can vary depending on storage limitations.
Please retain master copies of your images safe as we can’t be held responsible for the loss of your images. We are not a storage warehouse for images.
Our fair usage conditions may be contravened by high-frequency uploading of images, large volumes of images or user content and automated/scripted uploading of content or images.
We use reasonable commercial endeavours to provide image storage, but do not offer guarantees in terms of availability, speed, access or reliability.

Image specifications

We recommend images meet our recommended specifications (which may change periodically) or you may find you’re unable to upload them, or that it’s not possible to use the image with some products or that low image quality may affect the quality of the final product.
We offer Pro Colour Correction as part of our software, and reserve the right to apply or offer techniques to make generally accepted improvements to image quality and storability.
We aim to retain images of sufficient quality for personalised products, but some loss and modification of detail may be apparent under close examination.

User content rules

Images and material uploaded to the site by a user are treated as user content, along with any material uploaded, distributed, communicated, transmitted or linked to by a user on and through, or in connection with Snapmad. It is subject to the following conditions, that it does not:
Infringe anyone’s copyright – you must own the copyright or ensure you have permission/licence to use a copyright image; contain any improper, illegal, discriminatory, defamatory or inciting material; infringe another person’s privacy or personal information without written approval; give the impression it emanates from us when it doesn’t; upload any computer viruses or anything else to interfere with the proper operation of Snapmad, observe our intellectual property rights; and contravene applicable laws or regulations.
We cannot control and do not monitor or pre-screen use of our site, and it is possible material that breaks our content rules may be accessible. We are not responsible for such images or user content, but if you become aware of any such material please contact us.
These terms are subject to our discretion, and images or other user content that appear to breach our content rules or stop any use of services may be deleted without notice, and we reserve the right to inform the relevant authorities.
To the extent that the law permits, you release Snapmad, its agents, directors, officers, and employees from all liability arising out of or in connection with any images or other user content.

Snap Savings

Snap Savings is unique to snapmad.com, you can't earn Snap Savings points anywhere else.
Snap Savings can not be exchanged for anything other than their intended use on and strictly limited to our website.
Each Snap Savings point is the equivalent to £0.01. Snap Savings are only awarded for each full £1.00 spent on the snapmad website, of the remaining total after any deductions.
Snapmad reserve the right to terminate the use of Snap Savings at any point, without liability to credit, reimburse or issue any cash alternative.

Our use of images

We may send you emails which include your images, or to create examples of personalised products that may be of interest to you. By uploading images, you consent to us doing this.

Terms of purchase

When a user confirms and places an order at the end of the checkout process on our website, a contract is created between you and us for the purchase of that product.
We will take payment for your order by means of your nominated payment method and send a confirmation email detailing your order and other relevant information. When your order is being shipped, you will receive a dispatch email.
An order may be rejected if, for example, we cannot obtain payment authorisation, if the order breaches our terms or the use of images that are corrupted, unsupported technically or inadequate, or if a relevant pricing or product description error is identified or the product is unavailable.
If an order is rejected, Snapmad will contact you and reverse any payment made within 30 days. We’re not obliged to offer any compensation.
In the unlikely event that you are unhappy with a product, please email us in the first instance at support@snapmad.com with an explanation of the issue and photo of the product so we can assist you.
Please note: Unwanted personalised items cannot be returned to us.

Closing accounts

You can terminate your account at any time, but you may need to provide proof that you are the account holder. We reserve the right to close an account that breaks our terms of use or has been inactive for two years or more, and delete all images and user content associated with it.
We reserve the right to suspend or terminate a account at any time and without notice or when required to – for example when required to comply with an order, the law or request from a competent court, government or authority.
And should we do so, you acknowledge that we shall not incur any liability to you or to any other person.
If your account is terminated because of a breach of our terms, we reserve the right to refuse permission to create a new account.

Liability

We strive to provide an excellent service, but services are provided “as is” and we cannot and do not guarantee that Snapmad or the services will meet your requirements, nor the speed or delivery. Snapmad will have no duty, liability or obligation whatsoever to anyone save for those set out in these terms – except where such exclusion is not permitted by law.
We are not liable for user content or for any failure to perform our obligations under these terms caused by matters beyond our reasonable control without limitation – such as industrial disputes, breakdown of system, fire, etc.
You agree to indemnify Snapmad and its directors and employees and subcontractors against all liabilities, claims and expenses that may arise out of connection with breach of our terms by you or through your account, user content associated with you or your account.

Marketing

Personal data will only be shared within the 7dayshop group of companies, of which Snapmad is a member, to provide you with marketing information about goods and services that may be of interest to you unless we are required by law to do so.
If you have agreed to be added to our mailing list, you will also receive periodic marketing communication from us, which you may opt out of at any time.
In the event that we sell or buy any business or assets, we may disclose your data and account details to the prospective seller or buyer of such business or assets. If we or substantially all of our assets are acquired by a third party, your data and account details will be one of the transferred assets.
